Trump’s Classified Doc Case Dismissed By Judge

(NewsInsights.org) – Former President Donald Trump has been largely successful in delaying the majority of his criminal trials. His attorneys have filed several motions in each case, including the classified documents trial, in which he’s accused of taking sensitive information from his time in office and bringing it to his Mar-a-Lago home, violating the Espionage Act and other laws. A judge recently made the shocking decision to dismiss it.

On Monday, July 15, US District Judge Aileen Cannon, who is overseeing the classified documents case, issued a 93-page ruling. In it, she said that the Department of Justice’s appointment of special counsel Jack Smith was unconstitutional. She wrote that the DOJ’s action breached “the role of Congress in the appointment of constitutional officers and the role of Congress in authorizing expenditures by law.”

The win was Trump’s second legal victory in recent weeks, following the Supreme Court’s decision on presidential immunity. The decision also means the charges against Carlos De Oliveira and Waltine Nauta were dropped.

Trump celebrated the decision to dismiss “the Lawless Indictment in Florida” in a post on TRUTH Social, saying that “should be just the first step.” He said the remaining cases against him should also be dropped. He once again referred to them as “Political Attacks” and said they were a conspiracy to keep him from winning the election.

The DOJ has said it plans to appeal the decision, and the case will likely end up before the Supreme Court. A spokesman for Smith, Peter Carr, said Cannon’s decision “deviates from the uniform conclusion of all previous courts.” The federal agency has appointed special counsels for decades, and in 2017, courts upheld the appointment of Robert Mueller.

Trump was indicted on 40 charges in June 2023, nearly a year after several boxes of classified materials, including about top-secret US operations, were removed from his home.
