(NewsInsights.org) – In a filing opposing Hunter Biden’s legal contention that the Department of Justice’s (DOJ’s) prosecution of him is vindictive, selective, and a breach of the separation of powers, Special Counsel David Weiss confirmed, among other things, that the laptop recovered from a Delaware repair shop did indeed belong to Hunter Biden. Additionally, the prosecutor wrote that the files on the laptop and those subpoenaed from Apple’s Cloud service “were largely duplicative.”
Weiss filed the 52-page response on Tuesday, January 16, in answer to a motion filed on December 11 by Biden’s defense team asking Judge Maryellen Noreika to dismiss the case against their client. Attorney Abbe Lowell and his colleagues claimed the DOJ only chose to pursue the case against their client because his father is the sitting President of the United States and is running for reelection. They claimed Congressional Republicans coerced the DOJ to file charges prompted more by political expediency than criminal liability.
Additionally, the defense counsel alleged Social media posts from former President Donald Trump and threats from conservative Republican Congress members had driven the DOJ’s actions. Moreover, the defense team claims that Congressional influence on the case has violated the separation of powers clause and predisposed the court to an assumption of their client’s guilt.
Weiss pointed out that the defense team presented no evidence to substantiate their claims. He said a grand jury, not Trump or any GOP Congress members, returned the indictment against Hunter Biden in September 2023. He said the defense team didn’t meet even the minimum standards of evidence in trying to prove their claims of vindictive or selective prosecution.
Instead, Weiss pointed to evidence on Biden’s own laptop. It was the DOJ’s first official assertion that the laptop belonged to Biden and the first validation of the data contained on the hard drive. Weiss said both messages and photographs from around the time Biden purchased the gun showed his use of illicit drugs, proving he lied on the ATF form 4473 when he said he was not a habitual drug user or addicted to any unlawful narcotic or drug. Additionally, Weiss said white powder recovered from the leather pouch in which Biden stored the firearm tested positive for cocaine.
Judge Noreika has yet to rule on the motion and response.
